Agreement to the terms and conditions

These terms and conditions of sale apply to any order submitted through the website of the artist-painter Tamara Pierre-Louis (www.tamarapl.com). The confirmation of the purchase of any product offered by the artist-painter Tamara Pierre-Louis constitutes the express agreement of the Buyer to these terms and conditions of sale, without his or her handwritten signature being required for this agreement. These terms and conditions of sale govern all contractual relationships between the artist-painter Tamara Pierre-Louis and the client, both parties agreeing without reservation. These terms and conditions of sale will supersede any other conditions appearing in other documents, except with prior express, written consent. Orders

All orders are considered effective as of the date on which payment is received. Any order implies the acceptance without restriction or reservation of these terms and conditions of sale. Double clicking by the Buyer on the purchase order constitutes an electronic or digital signature, which has, between the parties, the same value as a handwritten signature. As soon as the Buyer submits the final order, he or she is considered to have accepted knowingly and without reservation these terms and conditions of sale, and the prices, volumes, and quantities of the products proposed for sale and ordered. The artist- painter Tamara Pierre-Louis reserves the right to cancel any order from a client with whom there is existing litigation related to the payment of a previous order.

 

Prices

The selling prices of products are in Canadian Dollars and are those in effect at the time of submission of the order by the Buyer. They do not include packing and shipping charges (or customs fees, brokering fees, or any other fees that may apply), which will be charged to the Buyer in addition to the prices of the purchased items. At the time the shipping information is entered on the secure purchase order, the Buyer must select the method of delivery. The packing and shipping charges will be confirmed by artist-painter Tamara Pierre-Louis.

The bill corresponding to the method of shipment agreed on between the Buyer and the artist-painter Tamara Pierre-Louis will be sent to the Buyer by e-mail at a later date.

The Buyer may select the option “Contact Tamara Pierre-Louis for another delivery method,” and an agreement must be concluded between the Buyer and artist-painter Tamara Pierre-Louis for the pick-up location.

The item purchased will be sent only after receipt of the payment corresponding to the packing and shipping method chosen.

Selling prices for all items may be changed by artist-painter Tamara Pierre-Louis at any time. The price indicated on the order confirmation is the final price.

All items are shown without taxes, so no tax is added to any item whatsoever.

 

Shipping methods (terms and conditions)

Packages are sent to the address indicated by the Buyer at the time of order payment using the secure payment service (PAYPAL) and appearing on the purchase order of the artist-painter Tamara Pierre-Louis.

The Buyer may opt for a shipping method that does not appear among the proposed methods at the time of the purchase confirmation. After the order, the artist-painter Tamara Pierre-Louis will communicate with the Buyer within a short time to discuss the most appropriate shipping method for the geographical, economical, or other situation.

The artist-painter Tamara Pierre-Louis will send to the Buyer by e-mail another PAYPAL payment request, which will include the packing and shipping charges and any other charges, if applicable, depending on the carrier chosen.

Packages are shipped from the postal address of artist-painter Tamara Pierre-Louis. Following the shipping confirmation, the buyer will immediately receive an e-mail from the artist-painter Tamara Pierre-Louis. The artist-painter Tamara Pierre-Louis guarantees that each package is prepared with care and that each work is protected as best it can be to limit any degradation during transportation. The artist-painter Tamara Pierre-Louis will not be held responsible for any delay in delivery by the carrier.

An order is shipped at the latest, 20 business days from the day following that on which the Buyer made the payment of his or her order (save for exceptional cases in which an item requires a specific fabrication time as indicated on the product notes of the corresponding item). If an error slipped into the product notes of the catalog and the item ordered is unavailable, especially if the item is being shown in an exhibition and cannot be offered until the end of the exhibition, the Buyer will be informed as soon as possible and may cancel his or her order. The Buyer will then have the choice to request a refund of all the money paid within 30 days after the payment was made, or to exchange the item for another one identical in value.

Please note that there is no shipping of packages from noon on Friday to Sunday night. The ownership of and responsibility for the merchandise are transferred from the website www.tamarapl.com to the Buyer (client) at the time of pick-up by the carrier. From that time, merchandise travels at the owner’s risk. The Buyer must inspect the packaging of the merchandise at the time of delivery and report any damage to the carrier on the delivery form, as well as to the artist-painter Tamara Pierre-Louis within 7 days maximum. If the delivered item does not correspond to the one ordered (damaged or nonconforming), the Buyer must submit a claim in writing within 7 days of receipt of the merchandise. Submission of a claim to the artist-painter Tamara Pierre-Louis can be done in priority by e-mail or mail specifying the reference number of the order and the nonconformity. The return of the item must be agreed to by the artist-painter Tamara Pierre-Louis. Any claim not made according to the rules outlined above and within the timeframe specified will not be honored and will relieve the artist-painter Tamara Pierre-Louis of all liability. Any item returned to the artist-painter Tamara Pierre-Louis for exchange or refund must be in its original packaging and must include the item and all its accessories. The cost of shipping for the return or exchange of merchandise is the responsibility of the Buyer.

 

Problems with delivery due to the carrier

Any anomaly concerning the delivery (missing item compared to the purchase order, damaged package, broken items, etc.) must be indicated distinctly on the purchase order under “handwritten reservations” accompanied by the client’s signature before accepting the package. This is the only means that both parties have available (the Seller and the Buyer [client]) to submit a claim to the carrier. The Buyer must, at the same time, notify the artist-painter Tamara Pierre-Louis of the problem as soon as possible so that appropriate measures can be taken.

 

Pick-up at the gallery by appointment only (free delivery)

We offer to the Buyer the option to pick up his or her order at a location that will be determined in advance by both parties and that will be near the address of the artist-painter Tamara Pierre-Louis, when applicable. If you choose this option at the time of order confirmation, the artist-painter Tamara Pierre-Louis will communicate with you promptly by e-mail or by phone in order to set up the appointment when the order is ready. International delivery

All international deliveries will be shipped by air. The Buyer who wishes to discuss with the artist-painter Tamara Pierre-Louis delivery by boat can do so by checking the box of the shipping method “Contact the artist-painter Tamara Pierre-Louis to select another delivery method” before confirming his or her order. We strongly recommend, however, that you use delivery by air. Orders to international destinations are not subject to Canadian taxes. The recipient (Buyer) will be responsible for these additional fees, duties, and taxes.

Delivery to the United States

Orders shipped to the United States are not subject to Canadian taxes. However,  like all orders that go through customs, they are subject to duties, American taxes, and customs fees. A bill for customs will be included in your package or will be sent by mail. The recipient (Buyer) will be responsible for these additional fees, duties and taxes, if any.

This is to verify, in advance, the amount of the fees at the your customs office. We will then be able to provide you with an estimate by e-mail within 5 to 8 business days.

 

Delivery delay

If there is an excessive delay compared to the estimated delivery time, the Buyer (client) must report this delay to the artist-painter Tamara Pierre-Louis by e-mail. We will contact the carrier used for the delivery of the order to initiate an investigation. In some cases, the investigation may take up to 21 days. If the package is found during the investigation, it will be rerouted immediately to the address indicated on the package. If, however, the item is not found as a result of the investigation, the artist-painter Tamara Pierre-Louis rejects any responsibility for the increase in the delivery time because of the carrier, especially in case of lost items or strikes.

 

Product Guarantee

The provisions of these terms and conditions do not preclude the Buyer from the legal guarantee that requires the professional seller to guarantee the item against the consequences of hidden defects in the item sold. The Buyer is expressly informed that the artist-painter Tamara Pierre-Louis is the creator (designer or producer) of these items in the sense of liability for defective or damaged items. More specifically, regarding the artworks, there is no guarantee of fabrication or labor. The Buyer understands that this is not an ordinary product that is mass-produced or made in a factory, and no user manual is provided with the product purchased.

The Buyer (client) has a deadline of 7 business days beginning on the date of receipt of the item to return the products ordered, for refund or exchange. If the deadline expires on a Saturday, Sunday, or holiday, it is extended to the next business day. The artist-painter Tamara Pierre-Louis must be notified of all returns using the contact methods mentioned in the “contact” section of the transactional website www.tamarapl.com, using the reference number indicated on the order. The shipping fees for the return of merchandise are the responsibility of the Buyer (client). All items must be returned to the artist-painter Tamara Pierre-Louis in absolutely perfect condition for resale, in their original state, well-wrapped, and with the invoice corresponding to the purchase. No refund will be issued for any product that is incomplete, marred, damaged, or whose original packaging is destroyed. The exercise of the right to withdrawal means that the Buyer will be given a refund within 30 days. Partial invalidity

Litigation

Sales of products and services of the artist-painter Tamara Pierre-Louis are subject to Quebec and Canadian laws in effect.
